The Terms and Conditions of Purchase establish the rights and obligations of all users of the MALLOL online store, in relation with the products and services that we offer via our website www.gatillepisphotos.squarespace.com.

By using the website www.gatillepisphotos.squarespace.com or placing an order via the same, you imply acceptance of the connection with these Terms and Conditions and our Privacy Policy. Therefore, if you are not in agreement with all the Terms and Conditions and with the Privacy Policy, you should not place any orders.

The purpose of the website www.gatillepisphotos.squarespace.com is the display and sale of products related with the photographs of Jordi Mallol i Comas.

These conditions may be modified; therefore, you must read them before placing every order.

Orders

When you place an order on www.gatillepisphotos.squarespace.com this is equivalent to the full and complete acceptance of the prices, of the description of the products for sale and of the general sale terms and conditions, which will be the only terms and conditions applicable to the contract thus concluded.

The purchaser hereby undertakes to make use of the website www.gatillepisphotos.squarespace.com only for consultations or legally valid orders. The purchaser also agrees to provide true and correct personal contact data, and thus consents to us being able to make use of such information in order to contact him/her if necessary.

Placing an order via www.gatillepisphotos.squarespace.com requires a guarantee that you are fully authorised to use the relevant payment card, should this payment modality be chosen. Only people with the necessary legal capacity to sign binding contracts relating to the kind of goods and services proposed on this website can place orders on www.gatillepisphotos.squarespace.com.

The delivery of orders will be made by MALLOL through its own means or through a transport agency (including the postal service) designated by MALLOL itself. Orders will be delivered to the address designated by the client. MALLOL does not assume any liability if the delivery cannot be made as a consequence of the details provided being inaccurate or incomplete, or if the delivery cannot be made due to absence of the addressee. Without prejudice to the above, MALLOL will adopt those measures demanded of sellers so that the delivery can be made as soon as possible, to the satisfaction of sender and recipient alike.

MALLOL hereby undertakes to deliver products in perfect condition to  the delivery address entered on the order form. You can request the delivery of articles to another address and to another individual other than the person signing the order.

No deliveries will be made to P.O. Box numbers.

With respect to deliveries at hospitals, public organisations and other addresses where there are restrictions affecting access to the general public, MALLOL does not guarantee that delivery will be made directly to the addressee, with the order standing as completed and free of liability once the delivery has been placed at the disposal of the addressee at the reception or other place that serves to control access.

The order delivery time will depend on the shipping method selected. Each shipping method has its own restrictions and/or charges that will be applied to your order. Working days are Monday to Friday, except for any days that are local or national bank holidays.

The calculation of this delivery time is based on various factors, including the destination address and the speed with which we can process or group together the order products for shipping (the general shipping time is indicated on the details page for each product and is for information purposes only, so that you can assess the speed of order shipment).

Payment

MALLOL offers the possibility of effecting payment via credit card or PayPal. The charge to your credit card will be made at the time the order is placed, via the secure payment gateway of the corresponding bank and once it has been checked that  the details provided are correct.

In this sense, the confidential data are encrypted (SSL) for transmission to the corresponding bank. The SSL encryption system that we use confers total security to data transmission online. Your data will enjoy total confidentiality and protection.

Security in electronic purchases is guaranteed by the corresponding bank. This has the security resources necessary to identify possible errors in the data provided when making card payments.

Credit card details are not recorded in any of our databases. They will only be used for the virtual PoS (Point-of-Sale) Terminal of the corresponding bank, through its Secure Payment Gateway.

Credit cards are subject to checks and authorisations by the issuing organisations, but if the bank does not authorise the payment, we will not be held liable for any delay or lack of delivery and we cannot formalise any contract with you.

MALLOL reserves the right to change payment modalities and to create new ones or to eliminate any of the existing ones, without  the user/client of www.gatillepisphotos.squarespace.com being able to make claims for this reason. However, if the change in the payment modality affects an order already made, from MALLOL we will contact the client to inform regarding this change, offering the option of cancelling the order if the client deems this appropriate.

Price, offer validity term and cost of transport

The prices indicated below each product are subject to tax, VAT is reflected separately, and it is necessary to add delivery costs which are specified for each destination and transport option. All prices are given in euros. The prices and conditions displayed are those valid at any given time and are only valid for the session in course. In the order confirmation information, prior to the purchaser accepting the operation, the prices of each of the articles selected are clearly specified, along with the specification of the delivery costs that will be applied to the operation and any promotions or discounts that may be applicable.

TRANSPORT COSTS:

Home deliveries: costs will depend on the product weight and the destination, in line with Post Office rates.

MALLOL reserves the right to modify at any time the sales prices that figure in www.gatillepisphotos.squarespace.com, but the articles will be invoiced on the basis of the rates in force at the time that the order is registered under reservation of availability on said date.

Returns

Right of withdrawal: Directive 2011/83/EU of the European Parliament and Council of 25 October 2011 on consumer rights, confers upon the Client the right to withdraw from the order requested within a term of 14 days from receipt of the same, further to communication with MALLOL (via an email message sent to gatillepisphoto@gmail.com), with refund of the price paid for the product. The return of the product will be carried out without penalties therefore MALLOL will proceed to refund the total amount of the purchase including, where applicable, the shipping costs. To be able to return the product, it must be in perfect condition. As for the packing of the product returned, it is not necessary for it to maintain the original conditions, but if this were the case, the product could suffer depreciation in its value.

Return due to product defects, defects occurring in transport or shipping error: if at the time of delivery it is visibly and clearly observable, without any need to manipulate shipping packaging or that of the product, that a product has defects caused by damages in transport or similarly a defect is appreciated in the goods received, the client can communicate this to MALLOL (via email addressed to gatillepisphotos@gmail.com) within a term of 2 months. MALLOL will take responsibility for substituting the item with a new one or refunding the price paid for it. Repair and/or substitution of the product will be free of charge for the consumer and user. Free of charge here will include the costs necessary to amend the lack of conformity of products with the contract, especially the shipping costs, as well as costs related with labour and materials.

In the case of a defective product, MALLOL will have to proceed, as applicable, to its repair, substitution, reduction in price or termination of the contract, all of which will be free of charge for the consumer and user. The seller is responsible for any lack of conformity manifested within a term of two years from the date of delivery. The consumer and user must inform the seller regarding the lack of conformity within the term of two months from becoming aware of the same.

This right of withdrawal will not be applied to those products acquired through the store within the website www.gatillepisphoto.squarespace.com which, in line with the relevant regulations, due to them being downloads of digital content, sound recordings, videos, disks and similar products, or others that for reasons of hygiene legally envisaged exceptions are not eligible for withdrawal.

Liability

MALLOL will not be held liable for any damages, whatever their nature, whether material, non-material, or corporal injuries, that may result from improper functioning or use of the products sold.

This also applies to possible modifications made to products by providers. MALLOL will not be held liable by a client or third party for any indirect damages, operating losses or interruptions to business that occur though whatever means, even if the damage, loss or harm could have been foreseen by MALLOL or if its possibility had been made know to the same.

MALLOL will not be held liable for non-compliance of the contract signed in the case of force majeure, interruption of business or total or partial strike, especially, of the postal services and means of transport or communications, floods, or fire.

The provisions of this clause will not affect the rights recognised by law to the consumer, nor the right to withdraw from the contract.

In the case of dispute, the client will be able, in the first instance, to contact MALLOL in order to reach an amicable solution.

Intellectual property rights and other rights

The purchaser recognises and accepts that all and any intellectual, industrial or other property rights and elements (including, without limitation, any copyrights, patents, brands, designs, photographs, images and source codes) relating to and accessible via the website of MALLOL are the exclusive property of MALLOL. The user cannot, directly or indirectly, copy, alter, publish, communicate, distribute, sell, or transmit the materials from this platform or its source code, or the downloads made, in whole or in part, without the written authorisation of MALLOL.

Applicable law

These General Conditions will be governed by and interpreted in line with the European legislation in force. For any dispute arising from the commercial relations between the user and MALLOL, the parties hereby agree to be bound by the stipulations of the legislation in force in Europe relating to the matter.
